These Terms of Use ("Terms") are a legal agreement between you ("you") and Furkan Kaynar, an independent developer trading as Appgea ("we", "us", "our"), governing your use of the "Solitaire" game for iOS and Android, including all of its features, virtual items and optional purchases (the "Game"). Appgea is a trading name, not a separate company.
By downloading, installing or using the Game, you agree to these Terms. If you do not agree, do not use the Game and delete it.
These Terms are our own document. They are the whole agreement about the Game between you and us, together with our Privacy Policy.
1. WHAT THE GAME IS
Solitaire is a single-player Klondike solitaire card game. You play through stages; each stage you clear raises your bonus and the next deal begins. The Game offers hints, undo, a joker card, an auto-collect button, statistics, achievements and several table themes.
The Game runs on your device. There is no account, no login and no server of ours. Your progress, statistics and settings are stored on the device you play on, as described in our Privacy Policy.
One thing worth knowing before you start: the first three stages are dealt so that a solution is guaranteed to exist. From stage four onward the deal is fully random, exactly like a real shuffled deck, which means some deals cannot be won no matter how well you play. That is authentic Klondike, not a defect.
2. LICENSE
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Game for your personal, non-commercial entertainment on devices you own or control. This is a license, not a sale. We and our licensors keep every right not expressly granted here.
3. WHO MAY PLAY
You must be at least 13 years old to use the Game, or at least 16 if that is the minimum age for consent to data processing where you live. If you are a minor under the law of your country, you may use the Game only with the permission of a parent or guardian, who is responsible for any purchase made from their device or store account. The Game is not directed to children.
4. ADVERTISING
The Game is free and is funded by advertising, supplied through Google AdMob. By using the Game you accept that it displays ads. Two things follow from that:
- Full-screen ads appear between games at a limited rate, and rewarded ads appear only when you choose to start one.
- Ad content comes from Google and its advertisers, not from us. We do not select individual ads, we do not endorse what they promote, and we are not responsible for the products, services or websites they lead to.
You may not interfere with the display of ads, automate or fake ad views, or use any tool that generates rewards without a genuine ad being watched. Doing so is ad fraud, and it is a breach of these Terms.
Your choices about personalized advertising, and how to change them, are set out in our Privacy Policy. VIP subscribers see no ads.
5. VIRTUAL ITEMS: HINT, UNDO AND JOKER CREDITS
The Game uses virtual credits. A hint credit reveals a suggested move, an undo credit takes a move back, and a joker credit places a wild card. You get a small number of each when you first play, and you can get more in three ways:
- Free, by watching a rewarded ad when you run out.
- Free, by claiming the credit gift on the main menu, which becomes available again after a cooldown.
- By buying a credit pack as an in-app purchase.
The following applies to all credits, however you obtained them:
- Credits are a limited, personal, revocable license to use a feature inside the Game. You do not own them.
- Credits have no monetary value. They are not currency, not property and not a stored balance. They cannot be exchanged, sold, gifted, transferred or redeemed for money or for anything outside the Game.
- Purchased credits are consumable and are non-refundable once delivered, except where a refund is required by the mandatory law of your country or granted by the store under its own policy.
- Credit balances are stored on the device you play on. They are not held on a server, they do not follow you to another device, and "Restore Purchases" does not bring back spent or lost credits. If you delete the Game, unspent credits are gone.
- We may change how many credits an ad, a gift or a pack gives, and what each credit does, as we balance the Game.
Because rewarded ads and gifts hand out the same credits for free, buying a pack is always optional. The Game is fully playable without ever paying.
6. VIP SUBSCRIPTIONS
VIP removes all ads and gives unlimited hints, undos and jokers. It is offered as an auto-renewing subscription with weekly, monthly and yearly terms, and also as a one-time lifetime unlock that is not a subscription and does not renew.
For the auto-renewing options:
- The price, the billing period and any introductory or trial offer are shown to you on the purchase screen before you confirm. Prices vary by country and may change; a change to a renewal price is handled by the store and, where required, needs your agreement.
- Payment is charged to your Apple Account or your Google Account when you confirm the purchase.
- The subscription renews automatically at the end of each period unless you cancel it. The store charges the renewal within 24 hours before the current period ends.
- You can cancel at any time, and cancellation takes effect at the end of the period you already paid for. There is no partial refund for the remaining days unless your local law requires one.
How to cancel. Cancellation is done in your store account, not by us, and we cannot cancel a subscription on your behalf:
- iOS: Settings → your name → Subscriptions, then select Solitaire and cancel. Cancel at least 24 hours before the period ends.
- Android: the Google Play app → your profile → Payments and subscriptions → Subscriptions, then select Solitaire and cancel. Cancel at least 24 hours before the period ends.
Deleting the Game does not cancel a subscription and does not stop it renewing. You must cancel it in the store.
VIP is attached to the store account you bought it with, not to a device and not to any account of ours. It works on any device signed in to that same Apple or Google account, and it cannot be shared with, sold to, or transferred to anyone else, except through your store's own family sharing feature where the store makes that available.
7. RESTORING PURCHASES
If you reinstall the Game or set up a new device, open the purchase screen and tap "Restore Purchases". This asks the store to confirm what your account has bought, and restores VIP, including the lifetime unlock.
Restoring returns entitlements only. Consumable credit packs are delivered once and consumed as you play, so they are not restored. You must be signed in to the same store account that made the original purchase.
8. REFUNDS
Purchases are made through Apple or Google, so refunds are handled by that store under its own policy, not by us. Ask Apple through https://reportaproblem.apple.com, or Google through https://support.google.com/googleplay/answer/2479637.
If you have mandatory refund or withdrawal rights under the consumer law of your country, they continue to apply and nothing here limits them. Note that for digital content delivered immediately, many jurisdictions treat your purchase as a request for immediate performance, which ends the statutory withdrawal period once delivery has begun.
9. ACCEPTABLE USE
You agree not to:
- copy, modify or create derivative works of the Game, except as the law allows;
- reverse engineer, decompile or disassemble the Game, except to the extent that restriction is prohibited by applicable law;
- rent, lease, lend, sell, redistribute or sublicense the Game;
- tamper with the Game's stored data, receipts or credit balances, or use modified clients, emulated purchases, patched binaries or cheats to obtain credits, VIP or scores you did not earn or pay for;
- abuse leaderboards or achievements with falsified results;
- remove or alter any proprietary notice; or
- use the Game in any unlawful way or in breach of these Terms.
If you break these rules we may block access to purchased features, remove credits obtained improperly, or end your license, as far as the law allows.
10. THIRD-PARTY SERVICES
The Game relies on services we do not run: Apple's App Store and Game Center, Google Play, Google Play Games, Google AdMob, Google Firebase (Analytics and Crashlytics) and RevenueCat. Your use of those services is subject to their own terms and privacy policies. We are not responsible for them, for their availability, or for the content they deliver.
11. PRIVACY
Your use of the Game is also governed by our Privacy Policy at https://appgea.com/solitaire/privacy/. In short: the Game is ad-supported and uses analytics and crash reporting, while your saved game, statistics and credits stay on your device.
12. CHANGES TO THE GAME
We may update, change, add to, or discontinue the Game or any of its features at any time, including game rules, scoring, credit amounts, the price and composition of purchases, and the range of subscription options. If we discontinue the Game entirely, auto-renewing subscriptions will stop renewing; purchases already used or consumed are not refunded beyond what the store's policy and your mandatory legal rights provide.
13. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Game is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
In particular, we do not warrant that the Game will be uninterrupted or error-free, that every deal can be won, that an ad will be available whenever you want to watch one, that hints will always find the best move, or that progress stored on your device will survive a device failure, a reinstall or a platform change.
Nothing in this section affects mandatory statutory rights you have as a consumer, including statutory warranty rights, which cannot be excluded or limited by law.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, lost progress, lost credits or lost profits, arising out of or relating to your use of, or inability to use, the Game.
- Our total liability for any claim relating to the Game is limited to the amount you actually paid us or the store for the Game and its in-app purchases in the twelve (12) months before the claim arose.
Nothing in these Terms excludes or limits liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, and any other liability that cannot be excluded under mandatory law, including mandatory consumer protection law.
15. TERM AND TERMINATION
These Terms apply for as long as you use the Game. Your license ends automatically if you breach them. You may end it at any time by deleting the Game; remember that deleting the Game does not cancel an active subscription (see section 6). Sections that by their nature should survive termination, including sections 5, 13, 14, 16 and 17, will survive.
16. APPLE AND GOOGLE
The Game is distributed through the Apple App Store and Google Play. Whichever store you obtained it from, these Terms are concluded between you and us only, not with Apple Inc. or Google LLC.
For the iOS version, you and we acknowledge and agree:
a) We, not Apple, are solely responsible for the Game and its content, and for any maintenance and support. Apple has no obligation to provide any maintenance or support for the Game.
b) Your license to use the Game is limited to Apple-branded devices you own or control, as permitted by the usage rules of the store you obtained it from.
c) We, not Apple, are responsible for any product warranties, to the extent not effectively disclaimed above. If the Game fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the Game, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
d) We, not Apple, are responsible for addressing any claim by you or a third party relating to the Game or your use of it, including product liability claims, claims that the Game fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
e) We, not Apple, are responsible for investigating and defending any claim that the Game infringes a third party's intellectual property rights.
f) You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
g) Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance Apple has the right to enforce these Terms against you as a third-party beneficiary.
For the Android version, your use is also subject to Google Play's own terms. Google is not a party to these Terms and is not responsible for the Game.
17. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The courts and enforcement offices of Istanbul, Türkiye have jurisdiction, and consumers in Türkiye may also apply to the consumer arbitration committee or consumer court for their place of residence.
If you are a consumer resident outside Türkiye, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually live, and you may be able to bring proceedings in the courts of that country.
18. CHANGES TO THESE TERMS
We may update these Terms, for example when we add a feature or change how purchases work. If we make a material change we will update the "Last updated" date above and post the revised Terms at the same address. Where the law requires it, we will ask for your agreement before a change applies to an existing subscription. Continued use of the Game after a change means you accept the updated Terms. If you do not agree, stop using the Game and delete it.
19. INTELLECTUAL PROPERTY
The Game, including its software, artwork, card designs, sounds, layout, text and the "Solitaire" build published by us, is owned by us or our licensors and is protected by intellectual property law. The rules of Klondike solitaire are in the public domain; our implementation of them is not. Except for the license in section 2, these Terms grant you no right in our intellectual property.
20. MISCELLANEOUS
If any provision of these Terms is found unenforceable, the rest remains in full force. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a transfer of the Game, without reducing your rights.
