1. Acceptance of Terms
By downloading, accessing, or using the Fitstrail mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Medical & Safety Disclaimer
Fitstrail is not a medical device. The App is designed for entertainment and motivational purposes only.
Consult a Doctor: Always consult with a physician before starting any new fitness program or walking routine, especially if you have pre-existing health conditions.
Physical Safety: You are responsible for your surroundings while walking. Do not look at the App while crossing streets, navigating traffic, or in potentially hazardous environments.
Accuracy: Step counts and distance calculations are estimates provided by your device's sensors and may not be 100% accurate.
3. Virtual Content
Virtual Nature: All routes, borders, passports, and stamps within the App are purely virtual. "Crossing a border" in Fitstrail does not grant you any legal right to enter a real-world country, nor does the "Passport" function as a valid travel document.
Routes: The routes depicted (e.g., Vienna to Prague) are simplified representations for gamification purposes and should not be used for real-world navigation.
4. Intellectual Property
Ownership: The App, including its original graphics (wolf themes, passport designs), code, and content, is the property of Furkan Kaynar and is protected by copyright and intellectual property laws.
License: We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
5. User Conduct
You agree not to:
Use the App for any illegal purpose.
Attempt to reverse engineer, decompile, or disassemble any aspect of the App.
Use any automated system (bots) to artificially inflate step counts or progress.
6. Third-Party Services and Ads
Ads: The App is supported by advertising via Google AdMob. We are not responsible for the content of third-party advertisements.
Links: The App may contain links to third-party websites or apps (e.g., Spotify, Instagram, TikTok). We do not control these services and are not responsible for their content or privacy practices.
Data Backup: Your progress data is stored locally on your device. We do not provide cloud backup. You are responsible for maintaining backups of your device (via iCloud, Google Drive, or other means) if you wish to preserve your progress.
7. Limitation of Liability
To the fullest extent permitted by law, Furkan Kaynar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury arising from your use of the App or your walking activities.
8. "As Is" Basis
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding the accuracy of step tracking or distance calculation.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.
